Romantix vs. City of Fargo civil rights trial delayed until 2025

FARGO (KVRR) – A trial in a civil rights battle involving the city of Fargo and an adult entertainment store has been delayed until next year.
Romantix Inc. claims the city’s Land Use Development Code is unconstitutional and violates the First and 14th Amendments.
In a 2022 lawsuit, Romantix accused the city of violating its rights by denying a “change of use” permit, which would allow Romantix to relocate from NP Avenue to a location on Broadway.
A bench trial has been scheduled with U.S. District Court Judge Peter Welte for July 15, 2025. It was previously scheduled to begin Dec. 17.
The city wants the lawsuit dismissed, claiming Romantix doesn’t have a First Amendment claim because it doesn’t plan to sell books or magazines at the new store.
