Police-involved shooting that killed two men in Moorhead was justified

MOORHEAD, Minn. (KVRR) — “There’s no question within my mind or after review of everything, the use of force was done to protect the peace officers or others from death or great bodily harm,” said Brian Melton, Clay County Attorney.
On August 11, 2025, Sheylin Marshall contacted 911 to report the father of her children, and their uncle had both assaulted her and were threatening her life. While Moorhead Police responded to the 2400 block of Third Avenue North, a gun was fired, and Red River Valley SWAT was called in. Fargo Police Officers, Sgt. Kyle Seehusen, Officer Tyler Seehusen, and Sgt. Michael Anderson fired their weapons and was placed on administrative leave.
“Our SWAT team, made up collectively of members of all our departments, trains very hard to prevent loss of life. But sometimes, as in the situation, those decisions are taken out of our control,” said Chief David Zibolski, Fargo Police Chief.
Zibolski said that since the criminal investigation has been closed by the Clay County Attorney, the files are being handed over to the Fargo Police Department to conduct an internal administrative investigation.
“From what I can see here, and I think the actions of the officers involved certainly there was grave danger to the Moorhead officers, to our SWAT team, and the children inside that apartment. It was pretty obvious that the work that they did in going in and dealing with that threat to not only attempt to make an arrest, but to get the kids out of a dangerous situation was heroic,” said Zibolski.
The shooting was investigated by the Minnesota Bureau of Criminal Apprehension.
Zibolski said that the three officers may soon return to being on duty as their investigation continues. We will have more information as it comes.

MOORHEAD, Minn. (KVRR) – Clay County Attorney Brian Melton says charges will not be filed against police officers involved in an August shooting that left two men dead in Moorhead.
Melton said there’s “no question in my mind” that the shooting deaths of 42-year-old Nathan Heiberg and 41-year-old Lucas Heiberg were justified.
The men were shot after police responded to an apartment in the 2400 block of Third Avenue North for a domestic assault. A woman told police that two men assaulted her, and that there were two kids inside the apartment.
A gun was fired when officers started to go inside. Red River Valley SWAT was called in and nearby apartments evacuated.
The woman and children were not hurt.
Three Fargo police officers who fired their weapons, Michael Anderson, Kyle Seehusen and Tyler Seehusen were placed on administrative leave.
Fargo Police Chief Dave Zibolski says an internal investigation is continuing, but says he agrees with Melton’s conclusions.
The Minnesota Bureau of Criminal Apprehension investigated the incident.
