Former Lincoln Stars Players Request Sex Charges Dismissal; Judge Says No

A judge denies a motion to dismiss charges against Thomas Carey and Brandon Smith.

The hockey players are accused of making a sex video with a 15-year-old girl at a Moorhead hotel.

Carey and Smith are charged with using a minor in a sexual performance and possession and distribution of child porn.

Defense attorneys claimed the case should be dismissed for several reasons including selective prosecution, abuse of prosecutorial discretion and freedom of speech.
