Two of the four men in the case of a deadly assault between Rick’s and Specks Bar in Fargo were back in court.
Joey Gaarsland died from the brutal attack in May.
Jessy Olson and Jason Oien heard testimony from a Fargo Detective who had information that would give probable cause that they committed the crime.
Detective Joshua Loos from the Fargo Police Department said, “He was beaten unconscious, he never woke up, there was an awful lot of blood.”
This is the description of Joey Gaarsland the night he was attacked in the parking lot outside of the two bars.
According to one bartender who tried to break up the fight, one of the men said…
“The brown haired male yelled at Joey Gaarsland, now you’ve got what you deserved,” said Detective Loos.
The defense asked if the incident was actually a “conspiracy.”
“What ultimately makes him leave, is that Jessy Olson and Scott Moen come out, they stand together and stand in those doors for a moment and then leave together,”Detective Loos.
Evidence found in the investigation was a cue–ball taken from the bar by Olson.
It has not been said if the cue ball was connected to this incident when one person tried to break up the fight.
“He went to grab the second person and pull them off this unconscious man he was struck in the back of the head by something, he doesn’t know what and immediately loss consciousness,”Detective Loos.
After listening to testimony, the judge did rule they both are under probable cause for committing the crime.
Olson did not make a plea, but Oien did saying he was not guilty on all four counts.
Oien will be back in court next month, Olson has no date set for his next appearance.
