Fargo City Commission Levies 2nd Liquor License Violation Against The Windbreak

FARGO, N.D. (KVRR) — The Windbreak is fined a second time for overserving and that includes a one-day suspension of it’s liquor license and a $1,000 fine.

Fargo City Commissioners held a special meeting to make the unanimous 4-0 decision to levy the fine, Fargo Mayor Tim Mahoney was absent from the meeting.

It was recommended during a January meeting of the Fargo Liquor Control Board.

Police say the man was served four mixed drinks and 10 shots of alcohol within a 96-minute period last October.

The man was later found passed out, couldn’t stand on his own and urinated himself.

There were 19 calls for police service at the bar in 2023 and one commissioner doesn’t think this second fine is going far enough.

“My question for the city attorney is can we suspend their license immediately? And what I would like to have us do is suspend it and have them, whatever they have to do to change their culture, change the owner, change the management. But, if we let them continue, this is a clear and present danger to our community,” said Commissioner Dave Piepkorn.

The city attorney advised the commission that a “breach of the peace” under the ordinance could result in a license suspension, but that would take a separate hearing.

The Windbreak can choose which day to serve it’s one-day liquor license suspension for this second fine.
