Charges Dropped Against Suspect in Bemidji Rape Case After DNA Doesn’t Match

BEMIDJI, Minn. (KVRR/FOX9) — Prosecutors have dismissed charges against a man suspected in a reported gang rape in Bemidji last fall after DNA tests came back without a match.
Oscar Luna of Texas was charged with criminal sexual conduct after an 11-year-old girl reported being attacked.
She was brought to the hospital after the assault and found to have injuries consistent with being raped.
Luna was located at the house the girl described along with 11 foreign nationals.
He was the only one arrested.
But on Tuesday, Beltrami County Attorney David Hanson said none of the DNA tested matched samples found during the victim’s rape test.
Authorities have no doubt the girl was abused, but haven’t been able to match those DNA samples to any suspect.
Luna is still facing criminal prosecution for drugs and he has two outstanding warrants out of Hennepin County.
