Lawyers For Sen. Mitchell Wants Burglary Tools Charge Dropped

DETROIT LAKES, Minn. (KVRR/FOX9) –Attorneys for Sen. Nicole Mitchell have filed a motion to dismiss an added charge of possession of burglary tools following an incident in Detroit Lakes in April 2024.

That is when Mitchell is accused of breaking into her stepmother’s home to steal some personal items from her late father.

The Democrat from Woodbury has pleaded not guilty to one count of burglary.

The additional charge was added months after the incident.

Her lawyers argue that it violates her due process, effectively giving the state “two bites at the same apple.”

A trial was delayed until the week of June 16, in order to not interfere with her work in the Minnesota Legislature.

Republicans have filed an ethics complaint seeking an investigation into what happened and whether she should continue to serve.
