Update On Diversion Lawsuit

New information has been released on the lawsuit against the diversion.

According to Fargo’s city attorney, there are now motions to dismiss the Richland-Wilkin JPA Minnesota claim.

A District Judge already issued a preliminary injunction prohibiting the lawsuit from moving forward in Minnesota state court.

The group filed last August challenging the entire project claiming it would have “devastating impacts” to area’s south of Fargo-Moorhead.

Fargo City Attorney Erik Johnson said, “Written arguments have been exchanged by the lawyers now and as of the last couple of days and those, and when that happens the arguments are presented to the judge all in mass and the next step is to schedule a hearing.”

That hearing could happen by the end of March.
